Spring 2018 - Bill 5: An Act to Strengthen Financial Security for Persons with Disabilities

The Act to Strengthen Financial Security for Persons with Disabilities will amend current Assured Income for the Severely Handicapped (AISH) legislation to allow families, guardians and AISH recipients to set up trusts to provide for persons with disabilities without negatively affecting a person’s eligibility for the AISH program. This would allow persons with disabilities eligibility for the living allowance, child benefit and personal benefits under the AISH program, while also allowing families and Albertans with disabilities to plan for their futures.

The new legislation will provide individuals with disabilities the same opportunity for financial stability as other Albertans.

People with disabilities will have access to funds for continued care and quality of life after their parents or guardians are gone.

Under the legislation, people will be eligible for the AISH program without having to deplete their trusts, and AISH clients will also have time to invest unexpected payments, like an inheritance, into an exempt asset without losing their eligibility.
